Abstract: | Bringing technology to the service of the administration of justice is a desire that was strengthened with the General Code of Process issued in 2012, but which was definitively consolidated with Decree 806 of 2020, which due to the Covid-19 Pandemic made imperative the implementation of Information and Communication Technologies in all judicial actions, thus giving Colombia the great step expected by many, a digital justice. This forced digital transformation has imposed not only a commitment but also a great challenge on the part of the National Government, the Superior Council of the Judiciary and the entire Judicial Branch, including the entire population in general. On the part of the State, public policies and strategies are being created, with significant costs, to ensure that this tool democratizes the administration of justice, guaranteeing its substantial elements, however, the digital divide in this country is seen as the perennial ghost that tries to prevent the macro objective and ultimate goal of digital transformation within the framework of inclusive access to the administration of justice. From the foregoing, the importance of this investigation follows, framed in the need raised since before the issue in 2012, of the General Code of Process, related to modern justice, with the implementation of Information Technologies and Communications in the Judicial Branch. However, it is impossible to ignore the great benefits that digital transformation offers to those who have access to it, it has been a total revolution, which, although somewhat traumatic in its beginnings due to its forced and unplanned implementation forced by the Covid-19 Pandemic, and issuance of Decree 806 of 2020, has been a path to achieve the long-awaited digital justice expected by many |
Description: | Llevar la tecnología al servicio de la administración de justicia, es un deseo que se fortaleció con el Código General del Proceso expedido en el año 2012, pero que se consolido definitivamente con el Decreto 806 del 2020, que por motivo de Pandemia Covid-19 se hizo imperativo la implementación de las Tecnologías de la Información y las Comunicaciones en toda actuación judicial, dando así Colombia el gran paso esperado por muchos, una justicia digital. Esta transformación digital forzada ha impuesto no solo un compromiso sino un gran reto por parte del Gobierno Nacional, del Consejo Superior de la Judicatura y de toda la Rama Judicial, inclusive de toda la población en general. De parte del Estado se están creando políticas públicas, estrategias, con significativos costos para lograr que esta herramienta democratice la administración de justicia garantizando sus elementos sustanciales, sin embargo, la brecha digital de este país se vislumbra como el fantasma perenne que trata de impedir el objetivo macro y fin último de la transformación digital en el marco de un acceso inclusivo a la administración de justicia. |
