Límites éticos y legales de la libertad de expresión en redes sociales en Colombia

Abstract

This research project addresses the ethical and legal limits of freedom of expression on social media in Colombia, in the face of the growing phenomenon of hate speech on digital platforms. In an environment where interaction is constant and often anonymous, the dissemination of messages that promote discrimination, violence, and social polarization has been facilitated. These discourses, although partially protected under the right to free expression, have negative consequences ranging from emotional harm to the impact on democratic coexistence. The central problem lies in finding a balance between protecting freedom of expression and preventing the spread of harmful content without incurring unjustified censorship. To this end, the study aims to analyze the current regulatory framework in Colombia, examine citizens' perceptions of this type of content, and clearly define what constitutes hate speech in the digital realm. It also seeks to reflect on individual and collective ethical responsibility in the use of social media. The results of this research will help clarify the limits of the right to free expression on the Internet, strengthen a culture of respect in virtual environments, and promote more effective regulation. The importance of the project lies in its relevance to Colombian society, where cases of harassment and digital violence are increasing daily, primarily affecting women and young people. Thus, a comprehensive analysis is proposed that articulates legal principles and fundamental ethical values.
